Crypto Ad Rules in 2026: What Gets Approved in the US, UK and EU

Short answer: In the UK, crypto ads must go through an approved route and carry a set risk warning. In the EU, MiCA requires marketing to be clear, fair, labelled and consistent with the white paper. In the US, there is no single crypto ad law, but paid promoters must disclose payment. In all three, never promise profits and always label paid content.

This is a plain-language summary, checked on October 13, 2026. It is not legal advice. Rules change, and each project is different. Speak to a lawyer in each country you target.

Why the rules matter for your ads

Crypto sites, Google and Meta all review ads. But approval from a website does not make an ad legal. The rules in each country you target still apply. Breaking them can lead to fines, takedowns and a damaged reputation.

United Kingdom

The UK has some of the strictest rules. The FCA’s rules for crypto promotions have applied since October 8, 2023.

Who can promote

A crypto promotion to UK consumers must take one of these routes:

  • It comes from an FCA-authorised firm
  • An FCA-authorised firm with the right permission approves it
  • It comes from a crypto firm registered with the FCA
  • It fits a legal exemption

What the ad must include

A clear risk warning. The FCA’s set wording is: “Don’t invest unless you’re prepared to lose all the money you invest. This is a high-risk investment and you should not expect to be protected if something goes wrong. Take 2 mins to learn more.”

What is banned

  • Bonuses for referring friends or for signing up
  • Calling crypto “safe”, “secure” or “easy” without balance
  • Hiding the risk warning or making it too small

First-time investors also get a 24-hour cooling-off period before they can invest.

What is changing

The UK is building a full new regime for crypto firms. The FCA published final rules in June 2026, and the new regime starts on October 25, 2027. Check the FCA’s guidance on crypto marketing for the latest position.

European Union

The EU’s MiCA regulation sets rules for crypto marketing in all member states.

What marketing must do

Under MiCA, a crypto marketing message must:

  • Be clearly marked as marketing
  • Be fair, clear and not misleading
  • Match the information in the white paper
  • Say that a white paper has been published, where one is required

Crypto service providers, such as exchanges, must also warn clients about the risks.

The transition has ended

The longest MiCA transition period ended on July 1, 2026. Firms without MiCA authorisation can no longer serve EU clients. In practice, only authorised firms should target the EU with ads.

National rules

Some countries add their own rules. France, for example, requires paid influencer content to be clearly labelled as advertising.

United States

The US has no single crypto advertising law. Several rules apply at once.

If a token counts as a security, anyone paid to promote it must disclose the payment. The SEC has fined celebrities who did not.

Endorsements must be honest

The FTC’s endorsement guides require clear disclosure when someone is paid, or gets free tokens, to promote a product. Fake reviews are banned.

Stablecoin claims are limited

The GENIUS Act, signed in July 2025, bans marketing stablecoins as legal tender, government-backed or insured. Its rules are still being finalised.

State laws apply too

States have their own consumer protection and licensing laws. Some, such as California, require a licence to offer crypto services.

A checklist for any crypto ad

  • Only target where you are allowed. Check your licence for each country.
  • Never promise returns. No “guaranteed”, “risk-free” or “100x.”
  • Show the risks. Add a risk warning where the law requires one.
  • Label paid content. Use “Ad”, “Sponsored” or “Paid partnership.”
  • Keep it consistent. Your ad must match your white paper and terms.
  • Back up every claim. If you say “lowest fees”, be ready to prove it.

How this affects where you advertise

Most big ad platforms add their own rules on top of the law. See advertising crypto on Google and Meta.

On Coinranking, every native spot carries a sponsored label. Every campaign is reviewed against quality, compliance and technical rules before it goes live. You can also target by region, so your ads only reach the places you are allowed to serve.

When you design your ad, follow our tips on crypto banner ads. Avoid the claims that get ads rejected.

FAQ

Do I need a licence to advertise crypto?

It depends on the country and the product. In the UK and the EU, most promotions of crypto services need an authorised firm. Ask a lawyer about your case.

Can I offer a sign-up bonus in my crypto ad?

Not in the UK. The FCA bans refer-a-friend and new-joiner bonuses for crypto. Other countries have different rules.

Does MiCA apply to firms outside the EU?

Yes, if they target EU users. Since July 1, 2026, firms without MiCA authorisation can only serve EU clients who contact them on their own initiative.

Is a sponsored label enough?

A label is required, but it is not enough on its own. The ad must also be fair, clear and not misleading.
